Irish baker Brennans has appealed against a ruling from the High Court that asks them to do away with packaging on its whole wheat bread that is sold by both companies, confusingly similar to that of its rival McCambridge.
McCambridge accused Brennans of imitating the packaging of its product and make it confusingly similar to the McCambridge product, which is a 500g rectangular loaf packaged in a resealable bag.
Supreme Court jury comprising five judges heard the appeal forwarded by Brennan’s, something that McCambridge opposed.
It is highly possible one of three or four other products look similar to the packaging when it is found flat in a shelf, claimed the firm.
McCambridge emphasized it was not afraid of the competition as his client provided the product sold by Irish Pride.
