A federal court in Boston ruled that Spire Corporation (Spire)'s Pourchez Retro hemodialysis catheter does not infringe a patent held by Teleflex Incorporated's subsidiary Arrow International, Inc. (Arrow), according to Mass Device. The catheters are used during hemodialysis, a process that filters blood in people with problem kidneys. In the law suit, Arrow alleged that the Spire.'s product infringed its Cannon catheter line.
US District Court for Massachusetts Judge Douglas Woodlock ruled that Arrow’s patent, which it acquired in its 2003 buyout of Diatek Inc., is invalid because the Cannon catheter is an obvious combination of known elements because nearly identical catheter designs were already in use when the patent application was filed.
Representatives from Spire and Teleflex did not immediately available for comment.
