Electromed settles trademark litigation

Electromed has settled a trademark infringement lawsuit brought against the company by Hill-Rom Services, Advanced Respiratory, Hill-Rom Company and Hill-Rom Services (collectively, Hill-Rom), regarding Electromed’s use of the term SmartVest.

The SmartVest is the airway clearance system which is designed to treat patients with compromised pulmonary function.

The companies said that the terms of the settlement agreement will not prohibit Electromed’s continued use of its SmartVest marks.

Electromed chairman and chief executive officer Robert Hansen said that they are pleased to have reached this agreement, which eliminates much of the expense and uncertainty associated with the litigation and enables the company to focus its resources and attention on providing airway clearance therapy devices to patients.

Headquartered in New Prague, Minnesota, Electromed manufactures, markets and sells products that provide airway clearance therapy, including the SmartVest Airway Clearance System and related products to patients with compromised pulmonary function.
